Structural Pest ControlBoard Notice Regarding Insurance Lapses in Coverage When the Structural Pest Control Board issues a businesslicense, the business license holder must also possess liability insurance. This is a statutory requirement under V.A.T.S. 135b-6 7a. In most cases, this insurance will lapse at the same timeas the business license. Approximately30 days prior to such lapse the Board, as a courtesy, advises licensees inwriting that their insurance is about to expire or cancel. For each license renewal date there is a sixty-day lateperiod. If either the business license is not renewed and/or theinsurance has lapsed, and the pest control operator provides pest controlservices, the pest control operator has just operated without a license. This is a violation of the SPCB regulations and the licensee is subject to administrativepenalties of up to $5,000 per day. What this means is that the pest control operator cannotperform services without violating the Structural Pest Control Act betweenSeptember 1 and the date the pest control operator receives renewal licenses. If a license lapse goes over sixty days, then a renewalcannot be granted. The licenseemust cease operation on the date the license and/or insurance expired and thecertified applicator(s) must retest in all desired categories. The business license holder may be issued another businesslicense if another certified applicator is brought in that does have a currentcertified applicator license and can act as the responsible certified applicatorfor the business until the expired certified applicator waitsfor retesting.
