STRUCTURAL PEST CONTROL BOARD

SUMMARY OF MEETING

February 15, 2000

 

The Structural Pest Control Board ("Board") meeting was held onTuesday, February 15, 2000 at the Joe C. Thompson Conference Center, Room 2.110,2405 East Campus Driver, Austin, Travis County Texas. Ms. Jo-Christy Brown,Chairperson of the Board, convened the meeting at 9:30 AM. All members werepresent. Glenn Grady represented Dr. Gold, the Texas A&M Board member.

Order of Business

Motion and second nominating Susan Runaldue as Recording Secretary. Motionapproved.

Motion and second approving the Board minutes from December 2, 1999 meeting.Motion approved.

 

Public Comments

Mike Dickens spoke to thank the Board for letting him sit on the rulescommittee.

Scott Turner from the Texas Pest Control Association spoke on fee changes onCEUs and reiterated the Associations position from the December 1999 Boardmeeting.


Public Comments and Hearing on the following Sections:

Motion and second adopting rules 593.2, 593.3 and 593.4 were passed.

593.2 - License Application
593.3 - Insurance Requirement
593.4 - Resident Agent

Motion and second to amend rule 593.5 was passed. Amendment removes therequirement that a person has to be licensed as a technician for six monthsbefore the individual can apply for an certified applicators license. Withthe amendment, the motion was seconded and passed.

593.5 - Examinations

Motion and second adopting rules 593.9, 593.10, and 593.13 were passed.

593.9 - Licensing of Persons with Criminal Backgrounds
593.10 - Licensing of Persons with Delinquent Student Loans
593.13 - Vegetation Management Technician (repeal)

Motion and second adopting rule 593.21. This rule will go into effect September1, 2000.

593.21 - Technician License Requirements

Motion and second adopting rules 593.23 and 593.24 were passed. The ExecutiveDirector says that unlike the other rules, these rules will go into effect onJune 1, 2000.

593.23 - Continuing Education Requirements for Certified Applicators
593.24 - Criteria and Evaluation of Continuing Education

Motion and second adopting rules 597.1 and 597.2 were passed.  TheExecutive Director says that unlike the other rules, these rules will go intoeffect on June 1, 2000.

597.1 - Grounds for Revocation, Suspension, Penalties, Reprimanding, Refusal toIssue or Renew Licenses
597.2 - Suspension or Revocation

Termimesh System Presentation

Michael Boyd presented the Termimesh system to the Board. The product wasapproved for use. Mr. Boyd will provide additional information to the Staff onthe system.

Discuss and Review of Possible Amendments

The Board discussed and reviewed the following possible amendments to the Board rules. The following rules listed below except for rules 599.4 and 599.5 received a motion and a second. Rule 599.15 and rule 599.17 received a friendly amendment removing conflicting language. The motion passed.

    Rules 599.4 and 599.5 received separate motions. Rule 599.4 received a motionand a second. Rule 599.4 was passed.
    599.4 - Termite Treatment Disclosure Documents
    Rule 599.5 received a motion. The motion was seconded and passed. The Staff wasdirected to examine the W.D.I. report again.
    599.5 - Inspection Procedures


    Discussion of Adopted Amendment 593.1, 593.6, 593.8 and 593.11 and effectivedate change.

    These amendments had gone into effect after being passed at the lastBoard meeting. A motion was made and seconded to delay enforcement to insureuniformity until September 1, 2000. The motion passed.


    Discussion of Technician Requirements in the Termite Category
    This discussion was a carryover from the last board meeting. Jerry Cates briefly spoke on a system that could allow technicians to observe if termites are trapped. The Chair again asked the Executive Director to review the idea of technicians reporting results from a trap.
     

    Committee Report from Strategic Planning Committee

    Report was made by the Vice Chairman and urged members to read the old language and compare to the new language.
     

    Review of Agreed Administrative Penalties and Consent Agreements.

    Administrative history being added was appreciated by the Board. Nochanges to reporting system was made.

    D.    Update on investigative staff
    E.    Update on Exams
    F.    Update on Request to Exceed Travel Cap
    G.    Appoint a Technician Training Task Force to DevelopTraining Requirements under Section 593.21

    Report and documents were submitted to the Board. Under item G., all of the industry board members volunteered to be available for the technician committee. Craig Manson, Darrell Hutto and Lou Arrechrio [sic] also expressed an interest in the committee.
     

    Executive Session for Annual Evaluation of Executive Director

    Session was held behind closed doors. When reported back to the public, the Board decided that the Executive Director would retain his position.
